return-to-work meetings

Purpose

Bradley "Brad" Woods is the ONA 111 Return-to-Work Representative.  As your union representative, I am here to guide and support you through the return-to-work process. This includes liaising with occupational health and ensuring your needs and accommodations are met based on your medical restrictions or limitations.

Scheduling your meeting

Return-to-work meetings typically involve your nurse manager, employee health services (WHS), and a union representative. It's our duty to ensure that the employer takes reasonable steps to accommodate your medical restrictions. It's important to note that employers seldom offer to schedule return-to-work meetings on their own. Therefore, it is crucial for you to request a meeting if you need one. You are entitled to this service through your union dues.

Union Representation and our Legal Obligation

ONA is legally obliged to represent its members and should be present at all meetings. If a meeting is scheduled without inviting the union, please inform me immediately for rescheduling or alternate representation.

Preparing for the Meeting

Before meeting with your employer, I'll review your medical restrictions and any past accommodations. You're welcome to send me your medical information with restrictions for review. We'll also discuss your ideas for accommodations in your unit.

Confidentiality of Medical Information

Rest assured, the medical information you provide, other than your restrictions, remains confidential and will not be shared without your consent.

Benefits of a Return-to-Work Meeting

  • Ensuring Proper Accommodation: By having a return-to-work meeting, we can ensure that your medical restrictions are fully understood and properly accommodated, avoiding any unnecessary strain or risk to your health.

  • Clarifying Expectations: These meetings provide an opportunity to clarify your duties and any modifications needed, ensuring both you and your employer have a clear understanding of what is required.

  • Addressing Concerns: It allows for the discussion of any concerns or questions you may have about your return to work, providing a platform to address them directly with all relevant parties present.

  • Legal Protection: Having a formal meeting documented ensures that the employer’s obligation to accommodate is recognized and can provide a basis for any future grievances if necessary.

  • Support and Advocacy: You will have the support and advocacy of your union representative throughout the process, ensuring your rights are protected and your needs are prioritized.

During the Meeting

At return-to-work meetings, I will act as your spokesperson and advocate, taking notes and aiding in discussions. Our goal is to present accommodation solutions to enable your return to work in your unit. If a return-to-work plan is proposed, we may request a caucus to review it together.

In Conclusion

We understand that navigating the return-to-work process can be challenging, especially when facing less-than-ideal circumstances with the employer. It's important to remember that, as your union representative, I am here to employ every process and resource at our disposal to advocate for your rights and needs. While we may encounter hurdles, our commitment to your fair and reasonable accommodation remains unwavering. Together, we will tackle these challenges, ensuring that your return to work is managed with the utmost respect for your medical limitations and workplace rights. You are not alone in this – we are equipped to handle tough situations and are prepared to stand firm for your best interests. Reach out at any time for support or to address any concerns you might have.
